The Philippines has started the live exchanges of electronic ASEAN Customs Declaration Document (e-ACDD) with 4 ASEAN Member States (AMS): Cambodia, Myanmar, and Thailand on 21 January 2022, followed by Malaysia on 25 January.

China heightened food safety management measures through the issuance of the General Administration of Customs of China (GACC) Decree nos. 248 and 249. Overseas producers of food exports to China shall abide by these regulations to obtain GACC certification. This means “No GACC certificate, No import to China”. This said policy will be implemented on 01 January 2022.

The Senate concurred the ratification of the Convention on Temporary Admission (CTA), also known as the ATA Carnet System, on 08 November 2021. Resolution no. 128 was adopted, having 22 out of the 24 Senators voted in favorably for its concurrence.
The Department of Foreign Affairs (DFA) will deposit the Instrument of Accession to the ATA and Istanbul Convention. This will then make the Philippines, the 88th member-state of the Carnet family.

The Bureau of Customs (BOC) allowed adjustments on minor errors, misdeclaration, or misclassification in the Export Declaration (ED) form without having to pay the fines. A fee amounting to Php 5,000 per clerical error and 250% surcharge per misdeclaration or misclassification is still imposed if discrepancies in the ED are fraudulent. BOC identified certain conditions that may not equate to an error provided that documentary evidence is present. The Department of Finance (DOF), Bureau of Customs (BOC), together with the Anti-red Tape Authority (ARTA) headways the onboarding activities of the eighteen (18) trade regulatory priority agencies in TradeNet; Six (6) of which were recently onboarded which include BAFS, SRA, FPA, EMB, NMIS and OMB. These agencies are still finalizing their module manuals, operational guidelines, and helpdesk in preparation for their live implementation. The TradeNet Steering Committee also pledged to include another twelve (12) agencies to onboard by September 2021.
The Bureau of Customs (BOC) prepares the PH live exchange of the ASEAN Customs Declaration Document (ACDD) by December 2021, via the TradeNet. The completion of the ACDD system’s bidding process received concurrence from the United States Agency for International Development’s (USAID) on 05 August 2021. BOC is now crafting a national master data plan with the USAID ASEAN Policy Implementation (API) Project Team for Interoperability.

EDC lauds the Department of Finance (DOF) and Bureau of Internal Revenue (BIR) on deferring the implementation of Revenue Regulation (RR) no. 9-2021, which levies 12% VAT on indirect exports pending issuance of an amendatory regulation. BIR will provide the transition process for those who already paid the 12% VAT while the RR was in effect from June 27 to July 21, 2021.

The Bureau of Customs (BOC) announced that exporters must use the new Certificate of Origin (CO) Form D starting on 16 June 2021. Exporters may access it at the BOC Customer Care Center (CCC) to process their export goods among ASEAN Member States (AMS).
Further, informing stakeholders that starting 01 August 2021, the old CO Form D will no longer be accepted by the AMS. For more details, you may reach the BOC-Export Coordination Division at ecd@customs.gov.ph. – MRJ
The Bureau of Customs (BOC) implements an alternative Prepayment System (BPS) to pay duties, taxes and other charges for all goods declaration lodged through the Electronic to Mobile (E2M) system. The BPS in compliance with the Customs Modernization and Tariff Act (CMTA), will only allow Exporters and importers to register an account for transaction payment purposes. Funds in the said account cannot be withdrawn but can be transferred to other prepayment accounts of the same holder’s name.
